1. Acceptance of Terms

By accessing or using PraxJobs ("Service", "Platform", "we", "us", or "our") at https://praxjobs.com/, you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

These Terms are an electronic contract. By clicking “I agree,” creating an account, or using the Service, you consent to enter into this agreement in electronic form and to the use of electronic records for all related notices and disclosures, consistent with applicable electronic signature and e-commerce laws (including, as applicable, the U.S. ESIGN Act and UETA, the EU/UK eIDAS Regulation, and analogous laws in your jurisdiction). No physical or digital signature is required.

For users located in India, you acknowledge that these Terms are an electronic record and an electronic contract within the meaning of the Information Technology Act, 2000 and the rules made thereunder. Your acceptance of these Terms by clicking “I agree,” creating an account, or using the Service constitutes valid consent and execution in electronic form; no physical or digital signature is required.

2. Description of Service

PraxJobs is an AI-powered job search platform that provides the following services:

  • AI-driven resume tailoring and optimization
  • Personalized cover letter generation
  • Comprehensive job research and market insights
  • Job matching and scoring tools
  • Interview preparation resources and practice tools
  • LinkedIn profile optimization
  • Application tracking and pipeline management

3. User Accounts and Registration

3.1 Account Creation

You must create an account to access certain features of our Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 User Information

You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy.

3.3 Account Responsibility

You are solely responsible for your account and any activities that occur under your account, whether or not you have authorized such activities.

4. Use of AI Services

4.1 AI-Generated Content

Our platform uses artificial intelligence to generate resumes, cover letters, and other job search materials. While our AI is designed to produce high-quality, relevant content, you acknowledge that:

  • AI-generated content may require human review and customization
  • You are responsible for reviewing and verifying all content before use
  • We do not guarantee the accuracy or effectiveness of AI-generated materials

4.2 Input Data

You are responsible for the accuracy and legality of any information you provide to our AI systems. You warrant that all information you submit is truthful and does not violate any laws or third-party rights.

5. User Conduct and Prohibited Uses

You agree not to use our Service to:

  • Upload false, misleading, or fraudulent information
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Distribute malware, spam, or other harmful content
  • Attempt to reverse engineer or compromise our AI systems
  • Use automated systems to access our Service without permission
  • Share your account credentials with third parties
  • Fail to comply with applicable local, national, and international laws and regulations in the jurisdiction(s) where you access or use the Service, including data protection, employment, and anti-discrimination laws
  • Fail to comply with data protection and privacy obligations applicable to you, including, as applicable, the EU/EEA General Data Protection Regulation (GDPR), the UK GDPR and the UK Data Protection Act 2018, and the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA)
  • Upload or process personal data without providing required notices, having a lawful basis, and obtaining any required consents under applicable law (for example, honoring “Do Not Sell or Share” choices where required by the CCPA/CPRA)
  • Use the Service in violation of export control, economic sanctions, or trade compliance laws, including the U.S. Export Administration Regulations, U.S. OFAC sanctions, and applicable UK and EU sanctions regimes
  • Use the Service to make or support decisions that unlawfully discriminate or otherwise contravene local hiring or employment laws
  • Fail to comply with applicable local laws and regulations in the jurisdiction where you access the Service, including, for users in India, the Information Technology Act, 2000 (and rules thereunder) and the Digital Personal Data Protection Act, 2023
  • Upload or process personal data of individuals located in India without a lawful basis under the Digital Personal Data Protection Act, 2023, or without providing any required notices and obtaining any required consents

6. Intellectual Property Rights

6.1 Platform Content

All content, features, and functionality of our Service, including but not limited to AI algorithms, software, text, graphics, and logos, are owned by PraxJobs and are protected by intellectual property laws.

6.2 User-Generated Content

You retain ownership of the personal information and content you provide. By using our Service, you grant us a limited license to use, process, and analyze your information solely to provide our services.

6.3 AI-Generated Output

Content generated by our AI systems based on your input becomes your property, subject to our right to use aggregated, anonymized data for service improvement.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

For users located in the European Economic Area (EEA) or Switzerland, we process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR). For users in the United Kingdom, we process personal data in accordance with the UK GDPR and the UK Data Protection Act 2018. Depending on your location, you may have rights including access, rectification, erasure, restriction, portability, objection, and the right to lodge a complaint with a supervisory authority. Details on how to exercise these rights are set out in our Privacy Policy.

For California residents, we process personal information in accordance with the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA). You may have rights to know, access, correct, delete, opt out of the sale or sharing of personal information, and to limit the use and disclosure of sensitive personal information, as described in our Privacy Policy. You can exercise these rights through the methods identified in our Privacy Policy.

When we transfer personal data internationally, we do so using appropriate safeguards described in our Privacy Policy, such as the European Commission’s Standard Contractual Clauses, the UK International Data Transfer Addendum, or other legally recognized transfer mechanisms.

For users located in India, PraxJobs will process personal data in accordance with the Digital Personal Data Protection Act, 2023, to the extent applicable. By using the Service, you consent to the processing and cross-border transfer of your personal data as described in our Privacy Policy, subject to applicable law. You may exercise rights available to you under the DPDP Act (such as access, correction, erasure, and grievance redressal) as set out in our Privacy Policy.

8. Subscription and Payment Terms

8.1 Subscription Plans

We offer various subscription plans with different features and limitations. Subscription details, pricing, and billing cycles are specified during the signup process.

8.2 Payment Processing

All payments are processed through secure third-party payment processors. You authorize us to charge your designated payment method for applicable fees.

8.3 Refund Policy

Refunds are subject to our refund policy as specified in your subscription agreement or as required by applicable law.

9. Service Availability and Modifications

9.1 Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. We may temporarily suspend Service for maintenance, updates, or other operational reasons.

9.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our Service at any time with reasonable notice to users.

10. Disclaimers and Limitations of Liability

10.1 Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Job Search Results

We do not guarantee job placement, interview opportunities, or any specific outcomes from using our Service. Job search success depends on multiple factors beyond our control.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY DAMAGES ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless PraxJobs, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

12.1 Termination by User

You may terminate your account at any time by following the account closure process in your account settings.

12.2 Termination by PraxJobs

We may suspend or terminate your account if you violate these Terms or engage in conduct harmful to our Service or other users.

12.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately, and we may delete your account and associated data in accordance with our data retention policies.

13. Governing Law and Dispute Resolution

Except as provided below for users located in India or where mandatory local law provides otherwise, these Terms are governed by the laws of Ontario, Canada, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Toronto, Ontario, except where prohibited by law.

Nothing in these Terms deprives you of the benefit of mandatory consumer protection laws of your place of habitual residence. If you are a consumer resident in the European Economic Area, the United Kingdom, or Switzerland, you may bring legal proceedings in the courts of your country of residence and applicable mandatory consumer protection law will apply. Where arbitration is not permitted by applicable law, disputes shall be brought in the competent courts of your country of residence or, if no mandatory law applies, in the courts of Toronto, Ontario, Canada.

For users located in India, these Terms shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be referred to and finally resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Bengaluru, Karnataka, India, and the proceedings shall be conducted in English. Subject to the foregoing, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction for interim relief and the enforcement of arbitral awards.

15. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or prominent notice on our platform. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on our Service, constitute the entire agreement between you and PraxJobs regarding your use of the Service.
